These Terms of Service ("Terms") govern your use of the website itskcc.com.my and services provided by KCC IT SOLUTION (Company Registration: 201203283296) ("we", "us", "our").
1. Services
KCC IT SOLUTION provides IT consulting, AI solutions, custom software development, blockchain solutions, payment gateway integration, and related technology services. Specific service deliverables, timelines, and fees are defined in individual project agreements.
2. Engagement Terms
- All project engagements require a signed agreement or statement of work (SOW).
- Project scope, deliverables, timelines, and milestones will be defined in the SOW.
- Changes to scope require written agreement from both parties.
3. Intellectual Property
- Upon full payment, clients receive ownership of custom-developed deliverables as specified in the project agreement.
- KCC IT SOLUTION retains ownership of proprietary tools, frameworks, and pre-existing intellectual property used in project delivery.
- We reserve the right to use anonymised project details in our portfolio unless otherwise agreed.
4. Payment Terms
- Payment schedules are defined in individual project agreements.
- Standard terms: 50% upfront deposit, balance upon delivery (unless otherwise agreed).
- Late payments may incur interest at 1.5% per month.
- All fees are quoted in Malaysian Ringgit (MYR) unless otherwise stated.
5. Confidentiality
Both parties agree to maintain confidentiality of proprietary information shared during the engagement. This obligation survives termination of the agreement for a period of 2 years.
6. Limitation of Liability
- Our total liability for any claim shall not exceed the fees paid for the specific service giving rise to the claim.
- We are not liable for indirect, incidental, or consequential damages.
- We are not responsible for losses arising from third-party services, force majeure, or client-provided data/content.
7. Warranties
We warrant that services will be performed with reasonable skill and care. We provide a 30-day defect warranty period after delivery for bug fixes related to agreed specifications.
8. Termination
- Either party may terminate with 30 days written notice.
- Upon termination, client shall pay for all work completed to date.
- Immediate termination is permitted for material breach that remains uncured after 14 days notice.
9. Website Use
- Content on this website is for informational purposes only.
- You may not reproduce, distribute, or modify website content without our written consent.
- We reserve the right to modify website content at any time without notice.
10. Governing Law
These Terms are governed by the laws of Malaysia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.
11. Dispute Resolution
Parties agree to attempt good-faith negotiation before pursuing legal remedies. If negotiation fails, disputes shall be resolved through mediation in Kuala Lumpur, Malaysia, before proceeding to litigation.
12. Changes to These Terms
We reserve the right to update these Terms at any time. Changes take effect upon posting to this page. Continued use of our services constitutes acceptance of updated Terms.
